This website, https://healingbowl.asia (the "Site"), is operated by Jubilant Profile Sdn. Bhd. ("we", "us", "our"), The Soho Suites KLCC, 20 A2-8-3, Jalan Perak, Kuala Lumpur City Centre, 50450 Kuala Lumpur, Malaysia.
We offer this Site, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all the terms, conditions, policies and notices stated here (the "Terms").
By visiting the Site or purchasing from us you agree to be bound by these Terms, including the additional policies referenced in them by link. These Terms apply to all users of the Site. If you do not agree to them, you may not use the Site.
Any new features or tools added to the store are also subject to these Terms. We may update, change or replace any part of these Terms by publishing the revised version on this page with a new effective date. Where a change materially affects an order you have already placed, the version in force when you placed the order continues to apply to it.
Section 1 — Use of the Site
You confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract.
You may not use our products for any unlawful or unauthorised purpose, nor may you breach any law in your jurisdiction, including copyright law, in your use of the Site. You must not transmit any worm, virus or other code of a destructive nature, attempt to hack, disrupt or circumvent the security of the Site, or corrupt data.
A breach of these Terms will result in immediate termination of your access to our services. Where a breach constitutes a criminal offence we will report it to the relevant authorities.
Section 2 — General conditions
We may refuse service to anyone, at any time, at our discretion.
You understand that your content (excluding payment card information) may be transferred unencrypted, may travel across various networks, and may be altered to conform to the technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the service, or any contact obtained through the Site, without our express written permission.
Headings in this agreement are for convenience only and do not affect its interpretation.
Section 3 — Accuracy and completeness of information
Material on the Site is provided for general information only. We are not responsible if information on the Site is not accurate, complete or current, and it should not be relied on as the sole basis for a decision without consulting more accurate, complete or timely sources.
The Site may contain historical information, which is provided for reference only and is not current. We may modify the contents of the Site at any time, but we have no obligation to update any information on it.
Section 4 — Sound therapy and health
The instruments, courses and sessions offered through the Site are intended to support relaxation and recovery. They are not a medical treatment, they are not a diagnosis, and they do not replace care from a licensed clinician. Nothing on the Site should be read as a promise of a therapeutic or clinical outcome.
Our sessions use an acoustic protocol, in which the bowls stand around the body, a contact protocol, in which a bowl is placed on the body, or a combination of the two. Where a session includes the contact protocol, tell us beforehand about pregnancy, a pacemaker or any implanted device, epilepsy or recent surgery, so that we can adjust the protocol or offer you the acoustic format instead. Group events and masterclasses use the acoustic format only.
By booking a session or a course you confirm that you have read this section, that you have disclosed anything relevant to your suitability, and that you take part voluntarily.
Where the Site links to websites we do not own or control, we are not responsible for their content, their practices or their collection of information about you.
Section 5 — Modifications to the service and prices
Prices for our products may change without notice. We may modify or discontinue the service, or any part of it, at any time. We are not liable to you or to any third party for any modification, price change, suspension or discontinuance of the service.
Section 6 — Products and services
Some products or services are available exclusively online. They may be limited in quantity and are subject to return or exchange only in accordance with our Refund Policy.
We have made every effort to display the colours and images of our products as accurately as possible, but we cannot guarantee that your screen will display any colour accurately. Each instrument is handmade, and minor variation in finish is a property of the object, not a defect.
We may limit the sale of our products or services to any person, geographic region or jurisdiction, on a case-by-case basis.
Section 7 — Orders, payment and formation of contract
When you place an order you will receive an email acknowledging receipt of it. That acknowledgement is not acceptance of your order. A contract between us comes into existence only when we send you confirmation that the goods have been dispatched.
All orders are subject to availability and to confirmation of the price. Where we discover an error in the price of goods you have ordered, we will contact you and give you the choice of confirming the order at the correct price or cancelling it.
To place an order you must be over 18, hold a valid credit or debit card, be the authorised user of that card, provide accurate details, and have sufficient funds to cover the purchase. We carry out a standard authorisation check; your card is debited on authorisation, and the amount received is treated as a deposit against the value of the goods.
We may refuse any order, and may limit or cancel quantities purchased per person, per household or per order.
You agree to keep your purchase and account information current, complete and accurate, including your email address and card details.
Payment methods. The payment methods available to you are those shown at checkout.
Dispatch. All orders are dispatched from our warehouse in Nepal. Delivery times vary by destination, and any import duty or tax levied by the destination country is payable by you.
Section 8 — Optional tools
We may give you access to third-party tools that we neither monitor nor control. Such tools are provided "as is" and "as available", without warranty, representation, condition or endorsement of any kind. Any use of them is at your own risk and discretion.
Section 9 — Third-party links
Content, products and services available through our service may include third-party material. We are not responsible for examining or evaluating it and give no warranty in respect of it. Please review the policies and practices of any third party before entering into a transaction with them.
Section 10 — Intellectual property
All intellectual property rights in the software and content made available on or through the Site — including text, photographs, audio recordings, the Healingbowl® trademarks and the product line marks — remain the property of Jubilant Profile Sdn. Bhd. or its licensors, and are protected by copyright and trademark law.
You may store, print and display content for your own personal, non-commercial use. You may not publish, alter, distribute or reproduce content in any form, or use it in connection with any business or commercial enterprise, without our written permission.
Section 11 — Comments and submissions
If you send us suggestions, proposals, plans or other materials, whether at our request or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium without restriction and without obligation to you.
We may, but are not obliged to, monitor, edit or remove content that we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable. You agree that your submissions will not infringe the rights of any third party.
Section 12 — Personal information
Your submission of personal information through the Site is governed by our Privacy Policy and our Personal Data Protection Notice.
Section 13 — Errors and omissions
Information on the Site may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct any such error and change, update or cancel orders affected by it at any time without prior notice.
Section 14 — Prohibited uses
You are prohibited from using the Site or its content for any unlawful purpose; to solicit others to take part in unlawful acts; to violate any regulation or law; to infringe our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, intimidate or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Site.
We may terminate your use of the service for any breach of this section.
Section 15 — Linking to the Site
You may link to our home page provided you do so in a way that is fair and legal and does not damage or exploit our reputation. You must not suggest any association, approval or endorsement where none exists, must link only from a website you own, and must not frame the Site within another site.
Section 16 — Disclaimer of warranties and limitation of liability
We do not guarantee, represent or warrant that your use of the service will be uninterrupted, timely, secure or error-free. The service and all products delivered through it are provided "as is" and "as available".
To the fullest extent permitted by law, we and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors are not liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages of any kind, including loss of profit, data, goodwill or the cost of substitute goods.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Malaysian law.
Section 17 — Indemnity
You agree to indemnify, defend and hold harmless Jubilant Profile Sdn. Bhd., its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, arising from your use of the Site or your breach of these Terms.
Section 18 — Severability, waiver and entire agreement
If any part of these Terms is found to be unlawful, void or unenforceable, that part is severable and does not affect the validity and enforceability of the remainder.
If you breach these Terms and we take no action, we remain entitled to exercise our rights and remedies in any other situation.
These Terms, together with the Refund Policy, the Privacy Policy and the Personal Data Protection Notice, constitute the entire agreement between you and us and supersede any prior agreements or understandings between us on the same subject.
Section 19 — Complaints and governing law
We operate a complaints procedure and will use it to try to resolve any dispute when it first arises. Please write to info@healingbowl.asia.
These Terms and any separate agreement under which we provide services to you are governed by the laws of Malaysia, and you agree to submit to the jurisdiction of the courts of Malaysia.
Section 20 — Language
These Terms are published in English. Any translation of them into another language is provided for convenience only. In the event of any inconsistency between the English text and a translation, the English text prevails.
